Agency 6 Community Photo Feature & Monthly Gift Card Drawing

Official Rules

1. Sponsor

The Agency 6 Community Photo Feature & Monthly Gift Card Drawing (the “Promotion”) is sponsored by Agency 6 (“Sponsor”).

2. Eligibility

The Promotion is open only to legal residents of the fifty (50) United States and the District of Columbia who are at least eighteen (18) years of age at the time of entry.

Employees, officers, directors, members, managers, representatives, agents, contractors, and immediate family members of Sponsor, and any entity involved in the administration of the Promotion, are not eligible.

Void where prohibited or restricted by law.

3. Promotion Period

The Promotion is conducted on a recurring monthly basis. Each monthly entry period begins at 12:00:00 a.m. Pacific Time on the first day of the applicable month and ends at 11:59:59 p.m. Pacific Time on the last day of the applicable month.

4. How to Enter

Instagram Entry Method

1. Follow @agency_6 on Instagram.
2. Post an original off-road photograph on Instagram.
3. Tag @agency_6 in the post.
4. Include the hashtag #Agency6.
5. Complete any entry form required by Sponsor.

Alternative Method of Entry

No purchase or Instagram post is required to enter. Eligible individuals may enter by completing Sponsor’s designated online entry form during the applicable Entry Period.

5. Content Restrictions

Submitted content may not:

• Infringe any copyright, trademark, publicity, privacy, or proprietary right.
• Depict illegal activity.
• Contain nudity or sexually explicit material.
• Contain hateful, discriminatory, defamatory, harassing, threatening, or obscene content.
• Promote violence, dangerous conduct, or unlawful behavior.
• Violate any applicable law, regulation, or platform policy.

6. Community Features

Sponsor may select and feature submitted content on its website, social media channels, digital advertising, print materials, email communications, catalogs, and other marketing or promotional materials.

7. Monthly Drawing

At the conclusion of each Entry Period, one (1) eligible winner will be selected in a random drawing from all eligible entries received during that Entry Period.

8. Prize

One (1) winner per Entry Period will receive one (1) Agency 6 Gift Card with an approximate retail value of One Hundred Dollars ($100 USD).

• The prize is non-transferable.
• The prize may not be substituted by winner.
• The prize is not redeemable for cash except where required by law.
• The prize is subject to all applicable terms and conditions.

9. Winner Notification and Verification

Potential winners will be notified via Instagram Direct Message, email, or other contact information provided during entry. Potential winners must respond within seventy-two (72) hours of notification.

10. Taxes

Winner is solely responsible for all federal, state, local, and other taxes, fees, assessments, and costs associated with acceptance, receipt, ownership, or use of any prize.

11. Content Ownership and License

Entrants retain ownership of their submitted content. By entering, entrant grants Sponsor a perpetual, irrevocable, worldwide, royalty-free, transferable, sublicensable, non-exclusive license to use, reproduce, publish, display, modify, adapt, edit, distribute, and otherwise exploit the submitted content for advertising, promotional, marketing, editorial, commercial, or business purposes.

12. Participant Representations and Warranties

By entering, each entrant represents and warrants that they own or control all rights necessary to submit the content, that the content is original, and that Sponsor’s use of the content will not violate any law or rights of any person or entity.

13. Publicity Release

Except where prohibited by law, participation and acceptance of any prize constitutes consent for Sponsor to use entrant’s or winner’s name, Instagram username, photograph, likeness, biographical information, city and state of residence, and submitted content for promotional purposes.

14. Release of Liability

By participating, entrants agree to release and hold harmless Sponsor, Instagram, Meta Platforms, Inc., and related parties from claims arising out of participation, submitted content, administration of the Promotion, or acceptance or use of any prize.

15. Indemnification

Each entrant agrees to defend, indemnify, and hold harmless the Released Parties from claims related to entrant’s participation, submitted content, breach of these Official Rules, or infringement allegations.

16. Limitation of Liability

The Released Parties are not responsible for lost, late, incomplete, inaccurate, delayed, stolen, corrupted, misdirected, or undeliverable entries, technical failures, human error, unauthorized intervention, or interruptions affecting participation.

17. Disqualification

Sponsor may disqualify any entrant who violates these Official Rules, tampers with the entry process, uses bots or fraudulent means, or acts in an inappropriate or disruptive manner.

18. Privacy

Information collected in connection with this Promotion may be used for administration of the Promotion and as otherwise described in Sponsor’s Privacy Policy available at Agency6.com.

19. Instagram Disclaimer

This Promotion is in no way sponsored, endorsed, administered by, or associated with Instagram or Meta Platforms, Inc.

20. Modification, Suspension, or Termination

Sponsor reserves the right to modify, suspend, cancel, terminate, or administer the Promotion differently if fraud, technical failures, legal issues, force majeure events, or other factors impair the Promotion.

21. Force Majeure

Sponsor shall not be liable for delays, interruptions, cancellations, or failures caused by events beyond its reasonable control.

22. Disputes

Except where prohibited by law, disputes shall be resolved individually and exclusively in the state or federal courts located in Orange County, California.

23. Governing Law

These Official Rules shall be governed by the laws of the State of California, without regard to conflict-of-law principles.

24. Severability

If any provision of these Official Rules is found invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect.

25. Winners List

For the name of a winner, where required by law, send a written request to Sponsor within thirty (30) days after the applicable drawing date.
